Actually... to clarify... New Destiny, as expected, will have to arbitrate, but Xplor was not forced to arbitrate... Xplor just has to wait its turn until that part of the matter is resolved.
The jugde said on the record that she would've issued an injunction if it weren't for the arbitration clause. Let's see what the arbitrator says in response to that.

Arbitration usually is a joke, but frivolous lawsuits are clogging the courts, so they have no choice but to put cases into arbitration. Nobody likes TRO's. They usually stiffle the wrong side.
