I don't like ratting anyone out, but this is a serious issue. People...friends of mine...could potentially get into trouble if I remain silent, so I feel I have a responsibility to publicize this.

A couple of days ago, I posted a thread, without naming any names, that I discovered an underaged model among several sets I purchased. The set in question was fully clothed and the model was 17, so I didn't feel it was serious enough to point any fingers...and the general response seemed to support this unnecessity. Since then, I've discovered 3 more models who were underaged and did indeed appear nude in the sets I purchased. One of them was only 15, while the others were 17. (There was a 5th model I discovered from the included docs, but I don't have any sets of her, so I can't really comment on that.)

I talked with Mark of DoMyPhoto.com via icq and his initial response was "Hi Logan, but she have over 18 when I sent it. What problem?" Suggesting it didn't matter how old she was in the photo...just how old she is now. I hope most people understand how wrong that thinking is.

Now, in all fairness, I should point out that what I base these claims on is (1) the birthdate on the model's ID and (2) the date she wrote on the release when she signed them. I cannot be sure when the set was actually shot, but who get's a model to sign a release 3 years before they actually shoot her?!? Besides, these documents are the only things a prosecuting body will have to go on as well. The girls could indeed be legal in the photos I have, but the only documentation I have support otherwise.

If anyone has any comments or suggestions, I would love to hear them.

They're not on the site...never were, luckily. I had only just gotten around to sorting through all the sets. I don't post sets until I confirm the docs...

I'd ask the seller for clarification; still possible she signed at 15, but shot the set at 18+. Although even in that case, I'd guess that a model release signed by a minor would be invalid in the US (a parent/guardian would have to sign), so even if she was 18 in these sets, but 15 when she signed the releases, he should have gotten new releases signed. (I could be wrong, I'm unfamiliar with the international legal issues).

Also, while you absolutely wouldn't want them on a porn site, pictures of simple nudity of minors are not inherently illegal in the US. They could be deemed illegal depending on the context of their display (e.g. juxtaposed with pornography), or depending on the style of photos (genital closeups, sexual poses, etc.). It would certainly be a mistake for the seller to have mixed nudes of minors when marketing to adult webmasters, but nudity isn't the same thing as pornography.

I just realized that one of the girls was only 17 when I received the set...no way she was legal in the photo.

I agree. These were NOT hardcore shoots. One of the alleged 17 year olds was spread...the 15 was topless/thong. I still wouldn't want to touch them with a 10 foot pole.

i guess/hope every serious content producer handles it the same way and lets the girl sign a new release for every shooting he's doing with her. and also a new id shot every time. and of course it would be impossible for you to prove to the DOJ that the girl might have been 18 at the time of shooting if you just have papers that make her 15 at that time.

now you should of course not use that sets, but i would be very surprised if a content producer after all this discussion sells sets of 15 year old girls. if that is true, it would be really sad. it's true that the laws about that in europe are much more liberal, but it's about protecting the customers that are in danger if they receive illegal content according to their local laws.

I thought about that, but I'm very hesitant about posting anything remotely linked with the set. I'll tell you that the girl does not look 15, and she had obviously gained some weight in the 1 year from the ID issue date and the date the release was signed...there's certainly a possibility Mark named and sent the wrong doc...but some of the others are too obviously the same girl for there to be a mistake.

I totally agree. And if this thread stops anyone from selling even potentially illegal sets, then I'm glad it did some good.
The ironic thing is the releases clearly state "I hereby affirm that I am over the age of 18 years...", when they are being signed by girls under that age.

I was going to ask if by chance the date was reversed, which has caused panic to me before as well when buying from europe. But it looks like with what you posted above you already accounted for that. Well except for the release signed one which doesnt match the date of june 11th (june 6th) yet either way the year is correct.

Did you get copies of the passports as well? If so have you checked those in relationship to the releases?

I have seen many russian ids, somehow I don't think that being in Russian hinders me or anyone who doesn't read Russian from reading a birth date in numeric format. And if it's not easy to match names from IDs to releases, you have more then just a little problem. Do you not realize what jepardy you're putting your clients in? Sloppy mistakes can put people in jail. Maybe you should find a burger flipping job?

Let me remind - Logan had not any problems from me since 2003. And when he told me about problems I asked - show me please wrong releases and I will change it. But Logan showed not it. Why? I asked him here and he not showed again. Why? I can delete problem BEFORE he will use it. If he have this problems really. Did you see our dialogue? I proposed delete problems, but Logan prefer GFY.

I have only good to say about Mark. I don't think those models are under age. I'm pretty sure there's just a mix up with docs or dates. Most of his models look 20+ and I'm pretty sure most of them are too.

Besides, if one sold sets of 15 years old girls just like that, wouldn't that person be cought by now? Again, I think Mark is clean on this one.

Out of the records, how come a teacher is in this biz? ;) (This comment has nothing to do with this thread, just surprised me as I read it.)

It would certainly be a mistake for the seller to have mixed nudes of minors when marketing to adult webmasters, but nudity isn't the same thing as pornography.
